Former Albanian judge Ervin Metalla has secured a ruling at the European Court of Human Rights (ECHR) regarding his dismissal from his position. The court determined that the decision to remove him was disproportionate and constituted a violation of Article 8 of the Council of Europe’s Convention on the Protection of Human Rights and Fundamental Freedoms (CEPEJ). The case stemmed from investigations conducted by the Albanian Integrity Commission.
These investigations revealed that former judge Ervin Metalla had taken out a loan for an apartment, subsequently transferring ownership to his brother to secure a more advantageous loan agreement. Metalla maintained that the funds received from the loan were utilized for the purchase of the property. Furthermore, the Integrity Commission’s findings indicated that Metalla simultaneously represented a company in Strasbourg while serving as a judge, a practice prohibited by Albanian law.
