Professor of International Law, Enver Hasani, stated that a recent Constitutional Court ruling dictates that the acting president, Albulena Haxhiu, lacks the authority to decree Albin Kurti, or any other individual, as prime minister. Speaking on the Rubikon program on Klan Kosova, Hasani clarified that this interpretation is derived directly from the court’s judgment, rather than representing his personal opinion. “According to the Constitutional Court’s ruling, Albulena Haxhiu cannot decree Albin Kurti as prime minister.

I am not saying this; the court said it,” Hasani stated. He added that political outcomes may differ from the court’s pronouncements, citing historical precedents where politics has determined different results. Hasani further explained that, according to the established legal framework, the authority to decree the mandate for forming a government rests with the country’s president.

Consequently, he argued, the process must first address the matter of the election itself before any appointment can be made. The core of his commentary centers on interpreting the specific directives issued in the recent Constitutional Court ruling.
