The Appeals Court has overturned a previous sentencing in a significant war crimes matter, sending the proceedings back to the lower court for a retrial. The ruling specifically nullified the judgment handed down by the Basic Court in Pristina, which had previously sentenced Shaqir Lutvija to ten years in prison for war crimes. According to reports, the Basic Court initially issued its guilty verdict against the accused Lutvija on November 11, 2025.

However, the Appeals Court reviewed the matter following an appeal filed by the defense attorney, Jovana Filipovic. The official decision from the Appeals Court confirmed that the judgment rendered by the Basic Court in Pristina—Special Department, Case No. 77/24, dated December 10, 2025—is hereby annulled.

Consequently, the Appeals Court directed that the entire case be returned to the court of first instance to ensure a fresh trial and subsequent decision. This reversal marks a procedural step in the ongoing legal action. The ruling underscores the appellate court’s function in reviewing the legal basis and procedural integrity of initial verdicts.

The transfer of the case back to the lower court means that the prosecution and defense will proceed with presenting evidence and arguments anew before the appropriate judicial body. The legal process concerning the charges against Lutvija will now resume at the trial level, pending the findings of the court.
