The High Court (IKD) recognizes changes in the Criminal Code; Shala: Disregarding the rulings of the Constitutional Court will be treated as a criminal offense.

Kosovo Justice Institute to Propose Criminalization of Non-Compliance with Court Decisions

The Kosovo Justice Institute (IKD) has announced plans to propose amendments to the Criminal Code of the Republic of Kosovo. The proposed changes aim to establish the non-implementation of decisions issued by the Constitutional Court as a criminal offense. According to a statement released following an interview with Ekonomia Online, senior researcher at IKD, Gzim Shala, explained that this initiative stems from ongoing concerns regarding the disregard for rulings by the court.

Shala stated, “Yes, initially, such an initiative from what we have announced as IKD represents a first action, a starter action for notifying the Assembly of the Republic of Kosovo…”

The IKD’s move reflects a broader effort to bolster the rule of law within Kosovo. The proposed changes would address a persistent issue of judicial compliance, bringing it into the realm of criminal offenses. This proposal will be submitted to the Assembly of the Republic of Kosovo for consideration.

The IKD views this as a crucial step in ensuring adherence to court decisions and strengthening the legal framework. The focus remains on establishing accountability and reinforcing the importance of judicial processes.
