The fate of Veliaj today at the High Court, the appeal regarding the security measure is reviewed

The High Court is scheduled to review, on Tuesday, an appeal lodged by Tirana Mayor, Erion Veliaj. The core of this appeal involves seeking a modification to the current security measure, which is designated as “arrest with detention,” advocating instead for a less restrictive condition. Simultaneously, the Constitutional Court has redirected another matter concerning Veliaj’s personal liberty back to the High Court for further judicial review.

In its ruling, the Constitutional Court has stipulated specific requirements for the High Court’s examination. The court mandates that the High Court must provide a detailed analysis regarding the proportionality of the imposed security measure relative to the public functions Veliaj executes in his capacity as Mayor of Tirana. Specifically, the judiciary requires the High Court to determine whether the measure of “arrest with detention” constitutes an unjustifiable infringement upon the right to hold elected office and the exercise of his mandated duties as the director of the capital’s municipality.

With the matter formally returned for reconsideration, the focus of the High Court will be on balancing the need for security measures against the constitutional rights associated with his public mandate. This ongoing review by the court represents a significant legal proceeding concerning the scope of executive authority versus individual civil liberties within the judicial framework.
