Changes are approved to the Law on the Taking and Transplantation of Human Body Parts for Healing Purposes

The Government of the Republic of Albania, acting upon a proposal from the Ministry of Health, has approved a Draft Law intended to amend and complete the existing legislation governing the taking and transplantation of human body parts for healing purposes. This legislative update introduces a standardized mechanism for recording citizen consent regarding post-mortem donation. Under the revised framework, every adult citizen will be required to provide a formal declaration regarding their willingness to donate organs and tissues after death during a routine visit to their family doctor.

This critical declaration will be digitally recorded within the national electronic health evidence system, known as “My Term.” A key feature of the new law is the provision that allows citizens the flexibility to amend their decision at any point in time, ensuring the process remains voluntary and revocable. The primary objective of these changes is to establish a comprehensive and accurate registry of public sentiment. By centralizing this information, the state aims to gain a clearer understanding of the population’s level of awareness, trust, and general willingness concerning organ donation.

The implementation of this updated legal structure is expected to streamline the process for medical professionals and improve the national capacity for transplantation efforts. The changes are designed to balance the critical medical need for donated materials with robust protections for individual autonomy, thereby strengthening the legal framework surrounding organ donation for the benefit of future patients.
