Kosovo Institute of Justice Criticizes Government’s Changes to Examination Board

The Kosovo Institute of Justice (IKD) has issued a statement responding to the Government of the Republic of Kosovo’s recent decision to alter the composition of the Examination Board for Jurisprudence. The government cited a significant backlog of complaints arising during the previous board’s tenure as justification for the change, asserting that these issues had impacted the perceived credibility of the examination process. However, IKD contends that this action is fundamentally at odds with legal frameworks.

The current members of the Examination Board for Jurisprudence currently hold an active mandate extending until December of this year, a period established through legally binding decisions. The government’s action to revoke these decisions is viewed as lacking a legal basis. Specifically, Law No.

08/L-033 on Jurisprudence Examination contains no provisions that would permit the removal of board members during an ongoing mandate. IKD’s assessment highlights a potential conflict between executive action and established legal procedures within the examination process. The institute intends to continue monitoring developments related to the board’s structure and function.
