Germany Increases Penalties for Serious Environmental Crimes

The German government has finalized a draft law significantly strengthening environmental protection measures and increasing penalties for serious crimes against the environment. The legislation aims to deter and punish actions resulting in substantial ecological damage. The newly approved draft expands authorities’ powers to investigate and prosecute serious environmental offenses.

A core element of the law establishes a minimum sentence of one year imprisonment for individuals intentionally causing “catastrophic” environmental consequences, including large-scale oil spills or similar incidents. Furthermore, the law introduces enhanced penalties for illegal dumping of toxic waste and violations concerning radiation exposure. These provisions specifically target offenses committed by organized criminal groups or undertaken for financial gain, with proposed prison sentences ranging from six months to a maximum of 10 years.

Justice Minister Stefanie Hubig stated that the strengthened legislation reflects a commitment to addressing serious crimes impacting the environment. The revisions represent a deliberate effort to ensure accountability and promote responsible environmental stewardship within Germany.
