The draft law concerning Fair and Adequate Representation, which is scheduled for review by Parliament, has been criticized for lacking substantive measures necessary to guarantee its effective implementation. Halil Snopçe, a deputy from the Alliance for Albanians, stated that the current draft law deviates significantly from the version previously proposed by the Socialist Party. According to Snopçe, a major deficiency in the legislation is its failure to establish a mechanism that prevents the misuse of declarations regarding candidates’ ethnic affiliation.
He argued that this omission means the proposed law does not eliminate the primary criticism leveled against the previous system of proportional representation. While the law contains declarative provisions addressing fair and adequate representation, it reportedly fails to provide genuine guarantees or an effective operational mechanism to ensure the practical application of these stipulations. Furthermore, the deputy noted that external bodies have already flagged similar concerns.
He referenced the Venice Commission’s assessment, which indicated that the existing framework does not create sufficient institutional structures or mechanisms to reliably guarantee the principles of fair representation. The core concern centers on the gap between the aspirational goals set forth in the law and the practical enforcement tools required to make the system truly adequate and functional for all stakeholders.
