The Constitutional Court of Kosovo has issued a ruling concerning the legality of a governmental decision pertaining to the construction of a specialized residential center. Specifically, the Court addressed the matter of the “Kosovo Residential Center for Autism, Down Syndrome, and Limited Abilities for Children, Adults, and Elderly.”
In its ruling, designated KO84/25, the Court accepted the petition filed by the Municipality of Gračanica. The decision, which passed with a six-vote majority, determined that Government Decision No.
05/218, issued on August 28, 2024, does not infringe upon the established competencies of local self-government entities. Furthermore, the ruling affirmed that the decision remains consistent with the constitutional provisions governing local authority structures within Kosovo. Crucially, the Court also took the action of lifting the provisional measure that had previously suspended the implementation of the initial decision, as well as any subsequent rulings related to its continuation.
The case centered on the scope and authority underpinning the government’s plan to establish the residential complex for individuals with developmental disabilities. By issuing this judgment, the court provided a definitive interpretation of the interplay between central government mandates and the constitutional framework supporting local municipal governance. The ruling thus clarifies the parameters within which such large-scale public infrastructure projects can proceed.
