IKD: Draft law for Byronë requires revision to guarantee the institution’s independence, legal certainty, and the protection of citizens’ rights

The Kosovo Institute of Justice (IKD) recently convened a press conference to release its report, titled “The Unjustifiable Property, Justifiable Justice.” During the event, IKD researcher Shqiponjë Gashi stated that the report was formulated utilizing comments submitted by the IKD to the Ministry of Justice. The primary objective of this publication is to contribute to the necessary improvements of the draft legislation and further strengthen the overall rule of law within the country. Adding context to the findings, senior IKD researcher Gzim Shala noted the protracted legislative process surrounding the Law on the State Bureau for the Verification and Confiscation of Unjustifiable Property.

According to Shala, this specific law has been under continuous discussion in Kosovo for the past six years. He highlighted the procedural history, noting that the draft law had been approved by the Government on three separate occasions. Shala further pointed out concerns regarding the consultation process, specifying that two of these approvals occurred without any public consultations, and the third instance was characterized by very short deadlines for input.

The release of this report by the IKD underscores the institute’s ongoing commitment to procedural fairness within the judicial framework. The document serves as a detailed analysis intended to guide policymakers in refining the current law, thereby ensuring that the principles of justice are robustly integrated into the national legal structure.
