Gruda’s Response to Confucius: What are we asking to send to the Constitution again?

Disagreement has emerged between political figures regarding the procedural timeline for the establishment of the Assembly’s constitution. Përparim Gruda, a deputy from the Democratic Party of Kosovo, addressed comments made by Glauk Konjufca, a deputy from the Vetëvendosje Movement, concerning the proper scope of judicial review. Gruda asserted that the mandate of the Constitutional Court is limited to the interpretation of the foundational Constitution.

He stated that the court’s authority should not extend to re-examining or interpreting its own prior rulings. Specifically, Gruda argued that such an action would constitute an “interpretation upon an interpretation,” suggesting a legal boundary on the court’s judicial reach. In response, Konjufca maintained the position that efforts to finalize the Assembly’s constitution must continue according to existing judicial determinations.

Konjufca referenced Ruling KO124/25, citing it as evidence that the Constitutional Court had explicitly determined a deadline. According to Konjufca, the ruling clearly mandated that the Assembly must complete its constitution within thirty days following the official certification of election results. The exchange highlights differing legal interpretations regarding the finalization of the constitutional framework and the precise scope of judicial authority in setting deadlines.
