The Administrative Court has denied the request made by the chief prosecutor of the Special Prosecution Office, Blerim Isufaj, to impose a security measure. This measure sought to suspend the public competition for the chief State Prosecutor until the resolution of an ongoing administrative conflict involving the Kosovo Prosecutorial Council (KPK). According to the court’s announcement, the General Department of the Administrative Court issued a decision (AP.nr.90/2026) on June 5, 2026.
This ruling rejected the plaintiff’s petition, which aimed to postpone the execution of the KPK’s decision (KPK.nr.268/2026) dated May 18, 2026. That earlier decision announced the public competition for the position of Chief State Prosecutor. The court determined that the plaintiff failed to substantiate the necessary risk of causing serious and irreparable damage, which is a prerequisite for granting a security measure.
Furthermore, the court noted that the contested decision pertains only to the initiation of a public competition procedure and does not represent a final determination regarding the selection or appointment of any candidate. The court’s decision also factored in the public interest associated with the routine and efficient operation of the prosecutorial system, concluding that suspending the competition process at this juncture was unwarranted. The announcement concluded by advising that dissatisfied parties have the right to appeal the decision to the Court of Appeal of Kosovo within seven days of its receipt.
