Investigator Naim Jakaj from the Institute for Justice of Kosovo explained that the Constitutional Court’s denial of Albulena Haxhiu’s request was anticipated.

He argued that the parliamentarian had made an error with this particular request. Specifically, Jakaj highlighted a 2016 Constitutional Court judgment which established that the deputies’ choice to be present or absent during presidential votes was their own. “As IKD, we showed that it was superfluous to file such a request to the Constitutional Court, given prior rulings confirming that Kosovo parliamentarians could not be compelled to participate in sessions.”

The Institute for Justice of Kosovo’s position remained consistent, asserting the unnecessary nature of the request.

The decision reflected established legal precedent regarding the rights of Kosovo parliamentarians concerning attendance at voting sessions.
