The Appeals Court has ordered a retrial in the case involving Endrit Nika, the accused, regarding the death of Argentine national Maria Clara Urdangaray. The decision follows the acceptance of an appeal filed by the defense counsel representing Nika. The legal proceedings concern allegations that Nika was responsible for the murder of Urdangaray, who was reportedly his girlfriend, in Lushnjë-Kosovo in 2023.
Previously, the Basic Court in Pristina had convicted Nika and imposed a sentence of 18 years in prison. During the initial trial, the prosecution had sought a sentence of life imprisonment for the accused. Tomë Gashi, Nika’s lawyer, confirmed the ruling, stating that the case of Endrit Nika is being sent back for a retrial.
The directive from the Appeals Court mandates a fresh examination of the evidence and arguments presented during the initial trial. The decision to order a retrial suggests that the appellate body found grounds to revisit the findings or the legal application of the original verdict.
