The Democracy Plus organization (D+) has formally demanded the cancellation of a specific tender issued by the Ministry of Culture and Tourism. This procurement process involves an allocation valued at 743,000 euros and pertains to the engagement of 26 individuals through Special Service Agreements (MShV), commonly understood as specific work contracts. D+ contends that the entire procurement procedure fails to comply with established public procurement legislation.
The organization asserts that the preliminary positions outlined in the tender documentation do not qualify as “special services,” and therefore, they should not be filled utilizing this particular contractual engagement mechanism. The objection is grounded in specific regulatory statutes. According to Article 57 of the Public Procurement Regulation, the use of Special Service Agreements is strictly limited.
These agreements are intended only for engaging experts who provide specialized services that the employing institution cannot guarantee through its own internal capacities or through standard recruitment channels governed by the Law on Civil Servants. Because the nature of the roles advertised falls outside these defined parameters, D+ argues that the tender itself is procedurally flawed. The organization maintains that using this contractual format for the specified roles is legally inappropriate, necessitating the immediate cancellation of the tender to ensure adherence to public spending regulations.
